Patchlamp, the texting service, has its own current copy of this page at patchlamp.com/terms. What follows stays as it was published.
These are the ground rules for working with me and for using the text-message website service. They're short because the real detail lives in the written agreement each client signs — where that agreement and this page differ, the agreement wins.
"I" and "me" mean Taylor Remund, a sole proprietor in Utah. "You" means a client who has engaged me for any of the services described at taylorremund.com/ai, and anyone that client authorizes to use the text-message service on their behalf. By engaging me or by texting the service number, you agree to these terms.
What I offer, and the published prices, are on the services page. Specifics for your engagement — scope, deliverables, price, term — are set in writing before work begins. Monthly plans are 12-month agreements with a defined scope and a buyout option, as stated there.
Some clients change their website by texting a phone number I operate. These terms apply to that number.
By texting the service number you consent to receive SMS and MMS messages from it in reply. Message frequency varies — you receive replies to the requests you send, plus occasional service notices. Message and data rates may apply. Reply STOP at any time to opt out; reply HELP for help. Wireless carriers are not liable for delayed or undelivered messages.
Anything you send to be put on your website — text, photos, images — must be yours to publish, or you must have permission from whoever owns it. You keep ownership of it. You give me permission to process it and publish it on your site, which is what you asked for. Photos published on a public website are public.
You own your website: its code, its content, its domain, and the accounts it runs on. If our agreement ends, you keep all of it and it keeps working. I own the tools, templates, and systems I use to deliver the service — including the text-message service itself, which runs on my equipment and my accounts and is not transferred when we part ways. On the text-message plan, the ability to change your site by text ends with the service; the site itself is yours and keeps working.
Prices and payment terms are in your written agreement. Builds are fixed-price, quoted after a discovery session. Monthly plans are billed monthly for a 12-month term with a buyout option if you want to end early. If a payment is more than 30 days late I may pause the monthly service until it's resolved; your website stays up either way.
I'll do careful, professional work, but the services are provided as-is. AI can misunderstand a request, and websites and third-party services can fail. To the extent the law allows, my total liability to you for anything arising out of these services is limited to the fees you paid me in the three months before the claim, and I'm not liable for indirect, incidental, or consequential losses such as lost profits or lost business. Nothing here limits liability that can't legally be limited.
Either of us can end an engagement as set out in the written agreement. When it ends, I'll hand over anything of yours I still hold, delete the message logs as described in the privacy policy, and remove your numbers from the service.
These terms are governed by the laws of the State of Utah. Any dispute will be handled in the courts of Utah, unless your written agreement says otherwise.
If these change, the new version goes here with a new effective date, and existing clients will be told directly. Changes don't reduce what you were promised in a written agreement already in force.
